1. Introduction
Welcome to OneFreight, a digital road freight logistics platform operated by OneFreight (Pty) Ltd ("we", "us", or "our"). OneFreight connects consignors who need goods transported with verified transporters across South Africa, and facilitates communication with receivers at the point of delivery.
These Terms of Use govern your access to and use of the OneFreight platform, including our website, web application, and any related services (collectively, the "Platform"). Please read them carefully before using the Platform.
2. Acceptance of Terms
By accessing or using the Platform (whether by creating an account, posting a load, accepting a booking, or simply browsing) you agree to be bound by these Terms of Use, our Privacy & POPIA Policy, and our Terms & Conditions.
If you do not agree to these terms, please do not use the Platform. Continued use after any update to these Terms constitutes acceptance of the revised version.
3. Eligibility
To use OneFreight you must:
- Be at least 18 years of age;
- Have the legal capacity to enter into binding contracts under South African law;
- Be a registered South African business entity (company, close corporation, sole proprietor, or partnership) if using the Platform for commercial purposes; and
- Provide accurate, complete, and current information during registration and maintain that information throughout your use of the Platform.
OneFreight is a business-to-business platform. Consumer use is not the intended purpose of the Platform, and the Consumer Protection Act 68 of 2008 may not apply to all transactions.
4. Account Registration and Security
To access most features of the Platform, you must register for an account. When registering, you agree to:
- Provide truthful and verifiable information, including your full legal name, business registration details, contact information, and any supporting documents we require;
- Keep your login credentials confidential and not share them with any third party;
- Notify us immediately at info@onefreight.co.za if you suspect unauthorised access to your account; and
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that contain inaccurate information, show signs of fraudulent activity, or otherwise violate these Terms.
5. Platform Use: Consignors
As a consignor (a party that posts loads for transport), you agree that:
- All load listings you post must be accurate, complete, and not misleading. This includes weight, dimensions, commodity type, pickup and delivery addresses, and time requirements;
- You will only post loads that are legal to transport under South African law, including applicable road freight regulations;
- You will not post goods that are hazardous, illegal, counterfeit, or otherwise prohibited without proper disclosure and compliant handling arrangements;
- You are responsible for adequate packaging and labelling of goods before handover to a transporter;
- You will make goods available for collection at the agreed time and location; and
- Payment obligations, once a booking is confirmed, are governed by our Terms & Conditions.
6. Platform Use: Transporters
As a transporter registered on OneFreight, you agree that:
- All information provided during vetting, including operating licences, public liability insurance, roadworthiness certificates, and driver details, is accurate and current;
- You will immediately notify us of any change to your licences, insurance, or fleet status that may affect your eligibility to carry loads;
- You will only accept loads that fall within the legal payload and dimensional limits of your vehicles;
- You are solely responsible for compliance with the National Road Traffic Act 93 of 1996, the Cross-Border Road Transport Act 4 of 1998, and all applicable provincial and local traffic regulations;
- You will handle goods with reasonable care and deliver them in the condition received, barring unforeseeable circumstances; and
- Your relationship with OneFreight is that of an independent service provider. You are not an employee, agent, or partner of OneFreight (Pty) Ltd.
7. Prohibited Conduct
You may not use the Platform to:
- Post false, misleading, or fraudulent load listings or transporter profiles;
- Circumvent the Platform by arranging payments or bookings directly with matched parties to avoid Platform fees;
- Harass, threaten, or abuse other users;
- Upload or transmit malware, viruses, or any code that could harm the Platform or its users;
- Scrape, copy, or systematically extract data from the Platform without written permission;
- Impersonate any person, business, or authority; or
- Use the Platform in any way that violates applicable South African law.
Violation of these prohibitions may result in immediate suspension or termination of your account, and we reserve the right to report unlawful conduct to the relevant authorities.
8. Intellectual Property
All content on the Platform, including the OneFreight name, logo, software, text, graphics, and data, is the property of OneFreight (Pty) Ltd or its licensors and is protected by South African and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the Platform without our prior written consent.
User-generated content (such as load descriptions or reviews) remains your property, but by posting it you grant us a royalty-free licence to use it for operating and improving the Platform.
9. Disclaimers
The Platform is provided on an "as is" and "as available" basis. While we strive to maintain a reliable and accurate service, we make no warranties, express or implied, regarding:
- The uninterrupted or error-free operation of the Platform;
- The accuracy of listings, profiles, or information submitted by users;
- The suitability, reliability, or conduct of any transporter or consignor; or
- The outcome of any freight booking made through the Platform.
OneFreight acts as an intermediary marketplace. We do not transport goods ourselves and are not party to the freight contract between a consignor and a transporter.
10. Limitation of Liability
To the fullest extent permitted by applicable law, OneFreight (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform.
Our total cumulative liability to you for any claim arising from your use of the Platform shall not exceed the Platform fees paid by you in the 30 days preceding the event giving rise to the claim.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud.
11. Termination
You may close your account at any time by contacting us at info@onefreight.co.za. Any outstanding payment obligations survive termination.
We may suspend or terminate your access to the Platform at our discretion, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent conduct, or if required to do so by law. Where feasible, we will give you reasonable prior notice.
12. Changes to These Terms
We may update these Terms of Use from time to time to reflect changes in the law, our services, or our business practices. We will notify registered users of material changes by email or by displaying a prominent notice on the Platform at least 14 days before the changes take effect.
Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance of the changes.
13. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the South African courts.
Before initiating formal legal proceedings, the parties agree to make a good-faith effort to resolve any dispute through direct negotiation or, if agreed, through mediation.
